John G. Marfoe


John Marfoe is a litigation associate who concentrates his practice in complex commercial litigation matters. Mr. Marfoe has significant experience in Intellectual Property litigation, having litigated a number of Lanham Act false advertising and trademark cases in federal courts throughout the country. Mr. Marfoe also has considerable experience defending consumer class action cases brought in both state and federal courts throughout the country.In addition, Mr. Marfoe has litigated large, complex securities fraud cases, nationwide antitrust class actions, and has participated in internal investigations related to the accounting practices of Fortune 500 companies.

Mr. Marfoe also maintains a very active pro bono practice covering a wide range of practice areas. He has assisted parties with securing their intellectual property rights, successfully represented a convict suffering from institutional abuse, and has helped an Iraqi refugee fleeing religious persecution secure asylum in the United States. In 2007, Mr. Marfoe was named as an Empire State Counsel Honoree for Pro Bono Services.

Professional Accomplishments

  • Represented a major appliance company in false advertising litigation against its main competitor, securing a jury verdict stating that the competitor deceptively advertised its products.
  • Helped secure summary judgment and dismissal of all claims against a major medical products supplier facing an antitrust class action with potential damages of nearly $1 billion dollars.
  • Provided advice to numerous companies with respect to their advertising in order to ensure that they comply with all federal and state laws.
